1. Acceptance of Terms

By accessing or using AfraiX's AI automation services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our Services.

2. Services Description

AfraiX provides AI-powered automation solutions including but not limited to:

Email and messaging automation
Customer service chatbots
Workflow automation and process optimization
CRM and business system integrations
Custom AI agent development

3. User Obligations

You agree to:

Provide accurate and complete information
Maintain the security of your account credentials
Use the Services only for lawful purposes
Not interfere with or disrupt the Services
Not attempt to gain unauthorized access to our systems
Comply with all applicable laws and regulations

4. Payment Terms

Payment terms are as follows:

Fees are based on the service tier and customization level
Payment is due according to the agreed billing schedule
Late payments may result in service suspension
All fees are non-refundable unless otherwise specified
We reserve the right to change prices with 30 days notice

5. Intellectual Property

All rights, title, and interest in the Services, including all intellectual property rights, remain with AfraiX. You retain ownership of your data and content, granting us only the license necessary to provide the Services.

6. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. We may perform maintenance, updates, or modifications that temporarily affect availability. We are not liable for service interruptions beyond our control.

7. Limitation of Liability

To the maximum extent permitted by law, AfraiX shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.

8. Data Protection and Privacy

We process your data in accordance with our Privacy Policy and applicable data protection laws, including GDPR. You are responsible for ensuring you have the right to share any data with us for automation purposes.

9. Termination

Either party may terminate the service agreement with 30 days written notice. We may terminate immediately if you breach these Terms. Upon termination, you must cease using the Services and we will provide your data in a standard format.

10. Warranties and Disclaimers

The Services are provided "as is" without warranties of any kind. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

11. Indemnification

You agree to indemnify and hold AfraiX harmless from any claims, damages, losses, liabilities, and expenses arising from your use of the Services or violation of these Terms.

12. Governing Law

These Terms are governed by the laws of Rwanda. Any disputes shall be resolved in the courts of Kigali, Rwanda.

13. Changes to Terms

We may modify these Terms at any time. Material changes will be notified via email or through the Services. Continued use after changes constitutes acceptance of the new Terms.
